Terms of Use

These Terms of Use (“Terms”) govern your use of Zenwise AI, including its website, applications, voice interactions, self-reflection features, educational courses, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms.
The Service is intended for individual, personal use.
2. What Zenwise Is
Zenwise is an AI-powered service for self-reflection, personal development, and educational courses.
You are interacting with an artificial intelligence system. Responses and other materials provided by Zenwise are generated using artificial intelligence.
Zenwise is not a healthcare provider and does not provide psychotherapy, counseling, mental-health treatment, diagnosis, medical advice, or other healthcare services. Using Zenwise does not create a therapist-client, doctor-patient, or other healthcare professional relationship.
3. AI Limitations
AI-generated responses may be inaccurate, incomplete, inconsistent, or based on an incorrect interpretation of what you have said.
You remain responsible for your decisions and for evaluating whether information provided by Zenwise is appropriate for your circumstances.
You should not rely on Zenwise as a substitute for medical, mental-health, legal, financial, or other professional advice.
4. Emergencies and Crisis Situations
Zenwise is not an emergency or crisis-response service and is not designed to continuously monitor you for emergencies or risks.
The Service may sometimes recognize or respond to concerning content, but we do not guarantee that it will detect self-harm, suicidal intent, abuse, danger, medical emergencies, or other crises.
We do not undertake to monitor conversations continuously, contact emergency services, or contact another person on your behalf.
If you believe you or another person is in immediate danger, use the emergency services available in your location.
5. Your Account
You are responsible for maintaining control of the email account and other credentials used to access Zenwise.
You may not use the Service unlawfully, attempt unauthorized access to the Service or another person's account, interfere with its operation, or use it to violate the rights of others.
We may suspend or terminate access where reasonably necessary to protect the Service, users, or comply with law.
6. Your Conversations
You retain any rights you have in information you provide to Zenwise.
You authorize us to host, transmit, process, and store that information as necessary to provide and personalize the Service, maintain continuity between conversations, generate responses and post-session materials, operate courses, and provide functionality you request.
Zenwise does not use your conversation transcripts to train or fine-tune its AI models.
Our processing of personal information is described in the Privacy Policy and Consumer Health Data Privacy Notice.
7. Subscriptions, Cancellation and Refunds
Prices, currency, billing period, applicable taxes, and renewal terms are shown before purchase.
Paid subscriptions automatically renew for the billing period shown at purchase until cancelled.
You may cancel a subscription at any time. Unless applicable law requires otherwise, cancellation takes effect at the end of the current paid billing period, and you retain access until then. You will not be charged for subsequent billing periods.
Payments already made are non-refundable, and we do not provide prorated refunds or credits for unused time, except where required by applicable law or where we correct a billing error.
Refund requests may be sent to support@zenwise.ai.
Payments may be processed by third-party payment providers or app stores. Where you purchase through an app store, its payment and refund rules may also apply.
Nothing in this section limits any mandatory statutory rights, including applicable withdrawal rights.
8. Statutory Withdrawal Rights
Consumers who are entitled to a statutory right of withdrawal may exercise that right independently of the cancellation policy above.

9. Intellectual Property
The Service, software, design, branding, course materials, and content provided by Zenwise are owned by or licensed to us and protected by applicable intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purposes.
10. Availability and Changes
We may modify, add, suspend, or discontinue features of the Service.
We do not guarantee uninterrupted or error-free availability of the Service or any particular feature.
11. Disclaimer
To the extent permitted by applicable law, the Service is provided “as is” and “as available.”
We do not guarantee that Zenwise will produce any particular psychological, educational, personal-development, or other outcome, or that its responses will always be accurate, complete, or appropriate.
Mandatory consumer rights remain unaffected.
12. Liability
We are fully liable where liability is mandatory by law, including for intent, gross negligence, injury to life, body or health, and liability under mandatory product liability law.
In cases of slight negligence, we are liable only for breaches of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on which you may ordinarily rely. In such cases, liability is limited to foreseeable damage typical for this type of contract.
Mandatory statutory liability remains unaffected.
13. Termination
You may stop using Zenwise at any time and may request deletion of your account by contacting support@zenwise.ai.
We may terminate or suspend access where you materially violate these Terms, create a security or legal risk, or where the Service is discontinued.
14. Changes to These Terms
We may update these Terms when the Service or applicable law changes.
We will make the updated Terms available and update the effective date. Where required by law, we will provide additional notice or request consent before material changes take effect.
15. Governing Law
These Terms are governed by the laws of Germany.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply under the laws of your country of residence.
The statutory rules governing jurisdiction apply.
